These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and the Foody development team ("we", "us", "our") governing your access to and use of the Foody mobile application ("App").
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.
You must be at least 13 years old to use Foody. By using the App, you represent that you meet this age requirement.
Foody is an AI-powered mobile application for personal, non-commercial use. The App provides the following core features:
You agree to use the App only for lawful purposes and in a manner consistent with these Terms.
To access most features of Foody, you must create an account using an email address and password, or via a supported third-party sign-in method (Apple, Google, or Microsoft).
You may delete your account at any time through the app's profile settings. Upon deletion, all your data — including fridge inventory, recipes, chat history, calorie logs, and Foodygram posts — will be permanently deleted from our servers. This action cannot be undone.
"User Content" means any content you create, upload, or submit through the App, including photos, text messages, voice recordings, recipe notes, product entries, and Foodygram posts.
By submitting User Content, you grant us a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the App's features to you.
You represent and warrant that:
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate.
Foody uses AI technology — specifically Google Gemini 2.5 Flash and Anthropic Claude — to power its recipe suggestions, product recognition, calorie estimation, chat assistant, receipt analysis, voice recognition, and other intelligent features.
By using AI features, you acknowledge and agree that:
We are not responsible for any loss, harm, or adverse outcome resulting from your reliance on AI-generated content.
You are solely responsible for:
Foody expressly disclaims any liability for food safety incidents, allergic reactions, illness, or any health-related consequences arising from your use of the App's features.
Free (Basic) Tier
Foody offers a free Basic tier with limited daily usage of certain AI features (including fridge photo analysis, receipt scanning, AI Chef chat, and food photo analysis).
Foody Premium
Foody Premium is a paid subscription that unlocks unlimited or significantly increased AI feature usage, animated themes, and exclusive features including Foodygram and advanced analytics. Premium is available in the following plans:

All subscription payments are processed through RevenueCat in conjunction with the platform's native payment system:
We do not directly collect or store your payment card information. All billing is managed by RevenueCat, Apple, and Google in accordance with their respective terms and policies.

ICE-Based Premium Access
Users may also activate temporary Premium access or purchase bonus feature uses by spending ICE virtual rewards within the app's in-app Shop. These transactions are processed internally and do not involve real-money payments.
ICE (🧊) is Foody's in-app virtual currency. ICE has no real-world monetary value, cannot be converted to cash, and is not redeemable for any goods or services outside of Foody.

Violation of these prohibitions may result in immediate suspension or termination of your account.
Foody integrates third-party services to deliver its features. Your use of these services is subject to their respective terms and privacy policies:
We are not responsible for the content, policies, or practices of any third-party services. Issues with third-party services should be addressed directly with those providers.
All content in the App that is not User Content — including but not limited to the app design, layout, graphics, icons, product catalogue images, code, text, and AI-system prompts — is owned by or licensed to us and is protected by applicable copyright, trademark, and other intellectual property laws.
You are granted a limited, personal, non-transferable, non-sublicensable, revocable licence to use the App for its intended personal purposes in accordance with these Terms.
You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the App without our express written permission.
AI-generated content produced by the App (recipes, suggestions, analyses) is provided to you for personal use only. We make no warranty regarding intellectual property rights in AI-generated output.
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for reasons including but not limited to:
You may terminate your account at any time by deleting it through the app settings or by contacting us at support@appfoody.com.
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property provisions) will continue to apply.
Active paid subscriptions terminated by us without cause will be refunded on a pro-rata basis at our discretion. Refunds for user-initiated cancellations are governed by Apple's and Google's refund policies.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, FOOD SAFETY INCIDENTS, ALLERGIC REACTIONS, OR PROPERTY DAMAGE — ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations of liability; in such jurisdictions, our liability is limited to the fullest extent permitted by law.
We may update these Terms from time to time to reflect changes in the App, applicable laws, or our business practices. When we make material changes, we will update the "Effective Date" at the top of this page.
For significant changes, we will notify you through the App or by email. Continued use of the App after updated Terms are published constitutes your acceptance of the new Terms.
If you do not agree to the updated Terms, you must stop using the App and delete your account.
